1. Description of the Service

PAWSI (PT PAWSI Digital Indonesia) is an all-in-one business management platform designed specifically for pet care businesses in Indonesia, including but not limited to grooming salons, pet hotels, daycare, pet transport, and pet shops. Availability of each feature below depends on the subscription plan you choose, as described in Section 5 and in the Subscription Terms and Conditions. Our services include:

• A Point of Sale (POS) system for service and retail product transactions
• Customer management and a pet database
• A booking and service scheduling system
• Inventory and product stock management
• Financial reports and business analytics
• A customer loyalty program
• Automated WhatsApp notifications
• Staff management and access control

2. Acceptance of Terms and Conditions

By registering for, accessing, or using PAWSI's services, you represent that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services.

3. Registration and Account

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use PAWSI's services.

3.2 Accurate Information

You agree to provide accurate, complete, and current information when registering for and using our services. You are responsible for updating this information if it changes.

3.3 Account Security

You are fully responsible for the security of your account, including keeping your password and login credentials confidential. You agree to notify us promptly if any unauthorised use of your account occurs.

4. Free Trial

PAWSI offers a 7-day free trial period for new users. During this period, you may access all service features at no cost. After the trial period ends, your account will automatically convert to the paid plan you selected, unless you cancel before the trial period ends.

5. Payment and Subscription

5.1 Subscription Plans

PAWSI offers two subscription plans:

5.2 Subscription Fees

Subscription fees are billed monthly or annually according to your chosen plan. Prices on this page are stated in US Dollars (USD). Customers billed in Indonesia are charged in Rupiah (IDR) and their invoice already includes Value Added Tax (VAT) at the applicable rate under Indonesian tax regulations.

5.3 Automatic Renewal

Your subscription will automatically renew at the end of the subscription period, unless you cancel before the renewal date. Cancellation can be made at any time through your account dashboard.

5.4 Refund Policy

Payments already made are non-refundable, except where required by applicable law. If you cancel your subscription, you will still be able to access the service until the end of the subscription period you have paid for.

6. Use of the Service

6.1 Permitted Use

You agree to use PAWSI's services only for lawful purposes consistent with your pet care business. You may not:

• Use the services for any illegal or unlawful purpose
• Interfere with or damage the integrity or performance of the services
• Attempt to access other users' accounts without authorisation
• Misuse service features for spam or fraud
• Reverse engineer, decompile, or disassemble our services

6.2 Data and Content

You retain full ownership of all data and content you enter into the PAWSI system. By using our services, you grant PAWSI the right to store, process, and use your data in accordance with our Privacy Policy.

7. Intellectual Property Rights

All intellectual property rights in the PAWSI services, including but not limited to software, designs, logos, and content, belong to PAWSI or our licensors. You have no right to use, modify, or distribute our intellectual property without written permission.

8. Termination of Service

8.1 Termination by the User

You may stop using the service at any time by cancelling your subscription through your account dashboard.

8.2 Termination by PAWSI

We reserve the right to suspend or terminate your access to the services if:

• You breach these Terms and Conditions
• Your payment fails or is overdue
• We detect suspicious or unlawful activity
• It is necessary to protect the security or integrity of the services

8.3 Effect of Termination and Data Retention

After an account is terminated or a subscription ends, your data will go through the following retention stages:

• Days 1–30: the account is in read-only mode; you can access and export data but cannot add or change data.
• Days 31–60: login access is disabled; data remains stored for recovery purposes upon written request.
• After day 60: all account data is permanently deleted and cannot be recovered, except for data required to be retained longer under applicable laws and regulations (e.g. tax documents).

9. Limitation of Liability

9.1 Service Provided "As Is"

PAWSI's services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the extent permitted by applicable law. We do not warrant that the services will be free of errors, interruptions, or security risks.

9.2 Limitation of Damages

To the extent permitted by applicable law, PT PAWSI Digital Indonesia's total liability to you for all claims arising out of or related to your use of the services over a 12 (twelve)-month period shall not exceed the amount of subscription fees you paid to PAWSI in the 3 (three) months preceding the event giving rise to the claim.

9.3 Exclusion of Damages

PAWSI is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business goodwill.

9.4 Exceptions to Limitation

The limitations of liability in Sections 9.2 and 9.3 do not apply to losses arising from wilful misconduct or gross negligence by PAWSI, breach of confidentiality obligations, or other matters that cannot be excluded or limited by law, including under Article 1366 of the Indonesian Civil Code (KUH Perdata).

10. Indemnification

You agree to indemnify and hold harmless PAWSI, its directors, employees, and affiliates from any claims, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the services
• Your breach of these Terms and Conditions
• Your violation of any third-party rights
• Content or data you submit to the services

11. Changes to the Service and These Terms

11.1 Modification of the Service

We reserve the right to modify, suspend, or discontinue any part of the services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the services.

11.2 Changes to These Terms

We may update these Terms and Conditions from time to time. Material changes will be notified to you by email or in-app notification at least 30 days before the change takes effect. Continued use of the services after the change takes effect indicates your agreement to the revised terms.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia.

12.2 Dispute Resolution

Any dispute arising out of or related to these Terms and Conditions will be resolved through:

1. Good-faith deliberation (musyawarah) between the parties for 30 (thirty) days
2. If negotiation fails, the dispute will be resolved through the South Jakarta District Court (Pengadilan Negeri Jakarta Selatan)

13. Electronic Transactions and PSE Status

PT PAWSI Digital Indonesia is a Private Scope Electronic System Operator (Penyelenggara Sistem Elektronik, "PSE") providing services in the form of electronic transactions in accordance with Law No. 11 of 2008 on Electronic Information and Transactions, as amended by Law No. 19 of 2016 and Law No. 1 of 2024 ("UU ITE"), and Government Regulation No. 71 of 2019 on the Implementation of Electronic Systems and Transactions. Your use of our services constitutes consent to electronic transactions with all their legal consequences, including recognition of electronic signatures, electronic contracts, and electronic evidence as valid means of proof.

14. Force Majeure (Force Majeure)

No party shall be considered negligent or in breach of these Terms and Conditions if the performance of its obligations is delayed or prevented by a force majeure event, including but not limited to: natural disasters, earthquakes, floods, fires, epidemics or pandemics, riots, rebellion, war, acts of government or competent authorities, mass power or telecommunications network outages, cyberattacks that could not reasonably have been anticipated, or other events beyond the reasonable control of the parties. The affected party must notify the other party in writing as soon as reasonably possible and take reasonable steps to mitigate the impact of the force majeure event.

15. Processing of Business Customer Data (Data Processing)

With respect to the personal data of your business's customers (including pet owners) that you enter into the PAWSI system, you act as the Personal Data Controller and PAWSI acts as the Personal Data Processor as referred to in Law No. 27 of 2022 on Personal Data Protection ("UU PDP"). PAWSI will process such personal data only on your instructions and for the purpose of providing the Services, in accordance with Article 51 of the UU PDP.

You must ensure that you have a lawful basis (including valid consent from the data owner) to collect and transfer such personal data to PAWSI, and you release PAWSI from any claims arising from the absence of such a lawful basis. Technical details of the processing are set out in the Privacy Policy and, where required, a separate Data Processing Agreement available on request at [email protected].

16. General Provisions

16.1 Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be removed and the remaining provisions will remain in effect.

16.2 Assignment

You may not assign your rights or obligations under these Terms and Conditions without our written consent. We may assign our rights and obligations without restriction.

16.3 Entire Agreement

These Terms and Conditions, together with the Subscription Terms and Conditions and PAWSI's Privacy Policy, constitute the entire agreement between you and PT PAWSI Digital Indonesia regarding your use of our services and supersede all prior agreements or understandings relating to the same subject matter.
